Terms of Service – 1nstant

By downloading or using 1nstant, you agree to be bound by these Terms of Service. Please read them carefully.

1. Acceptance of Terms

By accessing and using 1nstant, you accept and agree to be bound by these Terms of Service and our Privacy Policy.

2. Changes to Terms

We reserve the right to modify these terms at any time. We will notify you of any changes by posting the new Terms of Service within the app. Your continued use of 1nstant after any changes constitutes acceptance of those changes.

3. Use License

1nstant grants you a limited, non-exclusive, non-transferable, revocable license to use the app for personal, non-commercial purposes.

Some features of 1nstant are available through paid subscription plans (“Premium Services”).

Billing and Management

  • Subscriptions are purchased and managed through the Apple App Store or Google Play Store and processed by RevenueCat.
  • We do not collect or store your payment details; all billing is handled directly by the relevant app store.
  • Your subscription grants access to premium features for the duration of the subscription period.
  • Subscriptions automatically renew unless canceled in accordance with your app store’s policies.
  • You can cancel your subscription at any time through your app store account settings. Cancelling will stop future automatic renewals, but you will continue to have access to Premium Services until the end of your current billing period.

Refunds

  • Refunds, if any, are handled solely by the app store and are subject to their refund policies.

Suspension or Revocation

  • We reserve the right to suspend or revoke your subscription and access to Premium Services if you violate these Terms of Service or engage in prohibited activities.

Changes to Premium Services

  • We may update, modify, or discontinue features of the app, including Premium Services, at any time.
  • Pricing, features, or subscription plans may change. If a change materially affects your subscription, we will provide at least 30 days’ notice via the app, email, or other in-app communication before the change takes effect.

Important Considerations

  • By subscribing, you agree to these terms and acknowledge that your subscription is subject to app store policies.
  • Changes in subscription terms or pricing will not reduce your current subscription period; any updates take effect after your current period ends unless otherwise specified.

4. User Content

  • You retain ownership of any photos you create using 1nstant.
  • You are solely responsible for any content you create using the app.
  • You agree not to use the app for any illegal or unauthorized purpose.

5. Prohibited Activities

You agree not to:
  • Modify, adapt, or hack the app.
  • Use the app for any illegal purposes.
  • Attempt to access any other user’s data.
  • Use the app to violate any laws in your jurisdiction.

6. Third-Party Services

1nstant may use third-party services, including but not limited to:
  • Firebase Crashlytics and Firebase Analytics for crash reporting and app usage insights.
  • RevenueCat for subscription and purchase management.
Your use of these services is subject to their respective terms of service and privacy policies. For billing and subscription management, you are also subject to the Apple App Store or Google Play Store terms.

7. Data and Backups

  • You are solely responsible for backing up any content created or stored using 1nstant.
  • We are not responsible for any loss of data, whether due to app malfunction, device failure, or user error.
  • While the app provides backup functionality, we do not guarantee the preservation, integrity, or recovery of any backups.
  • You acknowledge that uninstalling the app may result in permanent data loss.
  • We strongly recommend maintaining regular and distinct backups of any important photos.

8. Disclaimer of Warranties

1nstant is provided “as is” without any warranties, expressed or implied. We do not warrant that the app will be error-free, uninterrupted, or free of harmful components.

9. Limitation of Liability

To the maximum extent permitted by law, in no event shall 1nstant’s creators be liable for any damages arising out of or related to:
  • The use or inability to use the app.
  • Loss of data or content.
  • Failed or corrupted backups.
  • Device storage issues.
  • Subscription billing issues or disputes (which must be resolved through the relevant app store).
  • Any other damages related to the app or its usage.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Australia.
